1. Acceptance of Terms
By accessing or using KidGuide™ ("the App," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. These Terms apply to all users, including visitors, registered members, and premium subscribers.
2. Description of Service
KidGuide™ is a faith-based parenting guidance platform that uses astrological natal chart data, AI-generated insights, and educational content to help parents better understand themselves and their children. All insights are provided for educational, informational, and entertainment purposes only and are not a substitute for professional advice.
3. Not Professional Advice
KidGuide™ does not provide medical, psychological, psychiatric, legal, or any other licensed professional advice. The content generated by our AI tools and astrological models is for general informational purposes only. You should always seek the advice of a qualified professional before making decisions about your child's health, well-being, education, or development. Reliance on any information provided by the App is solely at your own risk.
4. Eligibility
You must be at least 18 years old to create an account and use the Service. By registering, you represent and warrant that you are 18 or older and that all information you provide is accurate and truthful.
5. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. KidGuide™ is not liable for any loss resulting from unauthorized account access.
6. Children's Data
You may enter birth data (name, birth date, time, and place) for minor children in your care. By doing so, you represent that you are the parent or legal guardian of those children and have the right to submit this data. We treat children's data with the highest care. We do not knowingly collect data directly from children under 13. See our Privacy Policy for details.
7. Intellectual Property
All content, branding, software, and AI-generated insights on KidGuide™ are the property of KidGuide™ and its licensors, protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without express written permission.
8. Third-Party Services
KidGuide™ integrates with the following third-party services to deliver its features. By using the Service, you acknowledge and agree that your data may be processed by these providers as described:
Base44 — Our hosting and infrastructure platform. Stores your account data, profiles, and routes AI requests. Use of KidGuide™ is subject to Base44's terms.
AI Language Model Providers — Birth chart data (zodiac and planetary information) is sent to AI services to generate personalized insights and chat responses. This data does not include your name, email, or payment details.
Stripe, Inc. — Processes all payments. By completing a purchase, you also agree to Stripe's Terms of Service and Privacy Policy.
Email Delivery — Your email address is shared with our email provider solely to send you reminders and tips you have opted into. You may opt out at any time.
KidGuide™ is not responsible for the practices, availability, or content of any third-party services. Links to third-party policies are provided for your convenience.
8a. User-Generated Content
Any information you enter into the App (names, birth data, etc.) remains yours. By submitting it, you grant KidGuide™ a limited license to use it solely to provide the Service to you. We do not sell your personal data to third parties.
9. Prohibited Conduct
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service; (c) reverse engineer or copy any part of the App; (d) upload harmful or malicious content; or (e) misrepresent your identity or relationship to any child.
10. Assumption of Risk
BY USING KIDGUIDE™, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS ENTIRELY VOLUNTARY AND AT YOUR SOLE RISK. You understand that the App provides astrological and AI-generated content for entertainment and informational purposes only, and that any decisions you make — including decisions related to your children's upbringing, education, health, behavior, or well-being — are made entirely at your own risk and judgment. KidGuide™ assumes no responsibility for any outcomes, consequences, or results arising from how you interpret or apply any content provided by the Service.
11. Complete Waiver of Liability
BY ACCESSING OR USING THIS SERVICE, YOU KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVE ANY AND ALL CLAIMS, RIGHTS, AND CAUSES OF ACTION — WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED — AGAINST KIDGUIDE™, ITS CREATOR, OWNER, ADMINISTRATOR, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASED PARTIES") ARISING OUT OF OR IN ANY WAY RELATED TO YOUR USE OF THE SERVICE.
This waiver includes but is not limited to claims arising from: (a) reliance on AI-generated or astrological insights; (b) parenting decisions influenced by content on the App; (c) any inaccuracy, error, or omission in the Service; (d) interruption, suspension, or termination of the Service; (e) unauthorized access to your data; or (f) any other interaction with the Service.
YOU AGREE THAT THE RELEASED PARTIES SHALL HAVE ZERO LIABILITY TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, INCLUDING WITHOUT LIMITATION EMOTIONAL DISTRESS, LOSS OF DATA, LOSS OF REVENUE, OR ANY OTHER LOSS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE RELEASED PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY KIDGUIDE™ OR ITS REPRESENTATIVES SHALL CREATE ANY WARRANTY. THE ENTIRE RISK ARISING OUT OF USE OF THE SERVICE REMAINS SOLELY WITH YOU.
13. Indemnification
You agree to fully indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of or inability to use the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any decision or action you take based on content provided by the Service.
14. Release
To the fullest extent permitted by applicable law, you hereby release the Released Parties from all claims, demands, and damages of every kind and nature, known and unknown, arising out of or in any way connected with the Service. If you are a California resident, you expressly waive California Civil Code § 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release."
15. Modifications to the Service or Terms
We reserve the right to modify or discontinue the Service at any time without notice. We may update these Terms periodically. Continued use of the Service after changes constitutes your acceptance of the new Terms. We encourage you to review this page regularly.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the applicable jurisdiction.
17. Acknowledgment
BY USING KIDGUIDE™, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM — INCLUDING THE COMPLETE WAIVER OF LIABILITY AGAINST THE CREATOR AND ADMINISTRATOR OF THIS SERVICE. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE USING THE SERVICE.
